MI Supreme Court Rules in Dioxin Case

The state's high court has said "no" to local residents suing Dow Chemical for a medical monitoring trust fund.
In a five to two decision, the Michigan Supreme Court stated on Wednesday that the 170 residents cannot sue the Midland-based company to set up such a fund to pay for future dioxin-related illness. Dioxin exposure in humans and animals has been linked to skin and reproductive problems and possible cancers. The court's majority says the best place for the issue of medical monitoring trust funds is in the state legislature. But the two dissenting votes said the residents' hightened exposure to dioxin contamination could be considered an injury.
The contamination was caused by former manufacturing processes at Dow's Midland facilities.
