Dioxin Decision Delayed

The decision on a possible class action against Dow Chemical over dioxin contamination has been delayed.

Saginaw County Circuit Court Judge Leopold Borrello had set next Tuesday -- October 11th -- as the day he would release his opinion. Now, that date has been changed to Friday, October 21st. The court says the delay is needed to complete a full transcript of last month's class certification hearing.

The case stems from a lawsuit filed in 2002 by Gary Henry and over 160 Tittabawassee River floodplain residents against the Midland chemical giant for dioxin contamination on their property. If the class action is certified by the court, about 2,000 property owners could be represented in the case.
