Spilt Ruling in Dioxin Case Monday, November 10, 2003

Both sides in the dioxin case got what they asked for late last week. Saginaw County Circuit Court Judge Leopold Borello ruled that Dow can interview Tittabawassee River residents who are currently not part of the case against them. Dow says it wants to see if there are any common health claims among the residents. The company says health issues not geography should be the factor which would set any possible class action claim against them.

In a second ruling, Borello ruled against Dow. Stating that health, home and auto insurance as well as work records are not necessary to prove class. He sided with the plaintiffs that living on property contaminated by dioxin released from Dow's facility could be enough to show common claim against the company.

A final decision on class action status in the dioxin case is expected after a January 27th hearing in Saginaw County Circuit Court.
