Dow Appeals Section of Dioxin Lawsuit Friday, December 12, 2003

Dow Chemical is asking the Michigan Supreme Court to make a change in the lawsuit against them over dioxin contamination in the Tittabawassee River flood plain.

The company is asking the state's high court to reverse a requirement that the company would have to monitor the health of area residents if they lose the case. Dioxins are highly toxic byproducts of manufacturing and incineration production. Scientists says dioxins may cause cancer, birth defects and other health problems in animals and humans. The contaminated soil has been found in Saginaw county downstream from Dow's Midland facility.

River residents in the suit against Dow allege lost of property value and possible health damage.
