Tomorrow, the corporate assault on the ability of consumers and workers
to bring class action lawsuits comes to a head in the U.S. House.
The House will vote on H.R. 1115, which would effectively revoke the
class action rules in every state by sending class action cases to
federal court. The Senate may vote on a similar bill (S. 274) in coming
weeks.
Defendants believe they will have a huge advantage over consumers in
federal court. There it is harder to get a case approved for
consideration, federal judges are more conservative in interpreting the
law, and crowded court dockets will delay justice for months if not
years.
That's why America's biggest companies and industries - insurance,
banking, pharmaceutical, tobacco, auto, HMOs, chemical and more - are
furiously lobbying for this legislation.
